This MoonDL Service Agreement sets the terms and conditions under which the MoonDl.com site (which in the context of this agreement may also be referred to as "we" or "our company/site/service") offers its services to you ("User").

By registering or using the Moondl.com services, you fully agree to comply with the following conditions:

• Registration policy
  Our services are available to persons over 18 years old. The present Agreement confirms that the User is not a competitor of Moondl.com.
  
  
• Terms of Service
  The following terms apply to your access and usage of Moondl.com to upload, store, download and share files provided by Moondl.com and its affiliates. We reserve the right to change or modify the terms or any policy or guideline of MoonDL.
  
  
• The property
  You recognize that all materials and basic intellectual property rights are owned by MoonDL and its affiliates. MoonDL, the MoonDL logo, and other MoonDL products referenced in this document are trademarks of MoonDL and may be registered in certain jurisdictions.
  
  
• Responsibility for access
  The User is solely responsible for all access to and use of the Services. State-of-the-art security features that limit unauthorized access are provided and Moondl.com call on the User to use them, however MoonDL is not responsible for any unauthorized access to the Services provided to the User or its consequences otherwise.
  
  
• Responsibility for user credentials
  The User is solely responsible for maintaining the confidentiality of access information (login and password) and is responsible for all activities that occur with his account.
  
  
• Payment policy
  MoonDL offers a range of rates available for purchase. All transactions are made using all modern and available payment methods. MoonDL currently has no recurring payments.
  
  
• Refund policy
  MoonDL staff handles all refund requests on an individual basis. Our Customer Service staff review and evaluate each refund request based on various factors such as usage, time of purchase, date and method, and the issue described causing the refund. The decision is made based on the results of this internal review.

• User data
  The user is solely responsible for all data that he stores on the servers of Moondl.com. Moondl.com recommends User regularly and frequently back up data. The user is solely responsible for backing up data and is solely responsible for any lost or unrecoverable data. Moondl.com may store the User's data in its archives and is not responsible to the User for such stored data.
  
  
• Illegal/adult content
  You agree not to use MoonDL to upload, post, email, transmit or otherwise make available any Content that distributes: - messages of horror or depicts torture or death;
  - discriminates against any group of the world community, the content will be reported to the relevant legal authority and / or with the User's Internet provider;
  - harm or abuse of minors in any way, this includes any form of child pornography;
  - upload, post, email, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary right of any party.
  MoonDL does not authorize or permit site content or the transmission of data containing illegal or obscene material, pornography, or encourage illegal activities, including, but not limited to, gambling, offering to sell illegal weapons or substances, or promoting or publishing any content that may violate hate crime laws.
  MoonDL reserves the right to immediately suspend or terminate any account or transfer that violates this policy without notification.
  In addition, if a User violates any of these policies, MoonDL will actively assist and cooperate with law enforcement and other government agencies in collecting and providing information about the User's violation, illegal or obscene content, and those persons who may inappropriately have accessed, purchased or used illegal or obscene content in any way.
  
  
• Access and interference
  Violations or attempts to disrupt the MoonDL systems or interrupt the MoonDL services are strictly prohibited and may result in criminal and civil liability. Examples of systemic violations include, but are not limited to: Unauthorized access to or use of the MoonDL Services, including any attempt to investigate, scan, or test a system vulnerability or breach of security or authentication controls without the express permission of MoonDL; Interference with the Site for any User or network, including, but not limited to, deliberate attempts to overload the system and broadcast attacks; Using any device, software or procedure to interfere or attempt to interfere with the proper operation of the Site; - Any activity that imposes an unreasonable or disproportionately large load on Moondl.com's infrastructure. The User will not, under any circumstances, decrypt, extract, reverse engineer, or otherwise attempt to obtain the source code of the "software" (including tools, methods, processes, and infrastructure) underlying the Services or any other software on the MoonDL website.
  
  
• Copyright or trademark infringement
  The MoonDL services may only be used for lawful purposes. Transfer, distribution or storage of any material in violation of any applicable law or regulation, including export control laws, is prohibited. This includes material protected by patent, copyright, trademark, service mark, trade secret or other intellectual property rights. By using the Services, you guarantee that you are the author and copyright owner and/or the proper licensee of any content posted, and you represent and guarantee that no content infringes the trademark or rights of any third party. MoonDL reserves the right to remove Content that, at the discretion of Moondl.com, violates any laws or regulations.
  
  
• Responsibility for Content
  Notwithstanding the above, MoonDL is not responsible for monitoring Content provided by Users. MoonDL operates the Site and Services as a neutral party and Moondl.com does not routinely monitor, scan or regulate the use of MoonDL. MoonDL is not responsible for the actions, inaction, agreements, content, links to content, other products, services, comments, opinions, advice, statements, suggestions and/or other information provided by any User or other third party.
  
  
• Abuse of system resources
  The user must not be abused system resources, including but not limited to using content that consumes excessive processor time or disk space; using excessive bandwidth; or reselling access to content hosted on Moondl.com servers.
  
  
• Compensation
  You agree to defend, indemnify, and hold harmless MoonDL, its officers, from any claim, action or demand resulting from your use of the Service or your violation of present Agreement or other MoonDL policies, terms and conditions.
  
  
• Limitation of Liability
  MoonDL makes no warranty that: The service will meet your requirements; The Service will be uninterrupted, secure or error-free; The results that may be obtained from the use of the service will be accurate or reliable; No advice or information, whether oral or written, obtained by you from us or through the Service creates any warranty not expressly stated in these terms. You agree that MoonDL will not responsible for any direct, indirect, incidental, special, damages, including, but not limited to, damages for loss of profits, business reputation, use of data or other non-pecuniary damages.
  
  
• Force majeure circumstances.
  Our Services may be disrupted by numerous factors beyond our control, and we will not responsible to you for any delay or disruption to this Agreement caused directly or indirectly by causes beyond MoonDL control.
